[*]Donna Newby, 41 and her family were served an eviction notice last week
[*]They claim their landlord, David Love, told them they could stay until yesterday
[*]But they received a call on Friday to say he was throwing their belongings out
[*]Mr Love claimed he was 'cleaning the flat' and was carrying out his job professionally

These are the parts of the story that make no sense:

Due to Ms Newby's depression, caused by the death of her sister and the anniversary of her baby's death, it took six months to get the housing benefit organised.
The council have been paying money back to make up for some of the arrears but Ms Newby claims around £2500 was still owed.

I think I know what happened. She had her housing benefit paid directly to her and didn’t always pay all or any of it, each month.
That’s how she fell behind in such bad arrears.

It was a private landlord so the housing benefit would have been paid to her, not the landlord. It's not clear how long she defaulted on the rent, but it sounds like the landlord had had enough.

I think you are right, but does that excuse what the Landlord did with her property and into someone elses garden?

On the face of it it sounds a heartless and cruel thing to do.

Who knows what the true story is...but a mother of nine, no mention of any husband/s who falls far behind with her rent sounds like a nightmare tenant.

It was a private landlord so the housing benefit would have been paid to her, not the landlord. It's not clear how long she defaulted on the rent, but it sounds like the landlord had had enough.

Housing benefits can be paid directly to private landlords. My friend did it recently.

This seems a bit one sided 'disgraceful' landlord? We don't really know the whole story. If she hasn't paid the rent what is he supposed to do. If she was told to vacate by today, why didn't she have the majority of her stuff packed ready?. Does a responsible person have nine children with no means of financial support other than the tax payer? Where are is the husband/partner/husbands/partners?
she can have as many husbands/partners as she wants and as many kids as she wants or happen to come along more likely but make sure she or the fathers have the wherewithall to support these children.

Why should the landlord have to pay his mortgage on this place while someone lives there without paying rent? He was within his rights to chuck her stuff out. Once you have a High Court Writ, that's the procedure. So, if the landlord didn't do this eventually the High Court Enforcement officers would have done it.
