Girl who accidentally shot instructor with Uzi felt gun was too much for her
A lot to say about this, but I will just point out for now that I'm sure the details in the third paragraph here are going to reinforce a lot of stereotypes about America:

The 9-year-old girl who accidentally shot and killed her firing range instructor with an Uzi last week told her mother immediately afterward that the gun was too powerful for her and that it had hurt her shoulder, according to a Mohave County Sheriff's Office report released Tuesday.
The family huddled around the girl, fearing she was injured, and did not realize that instructor Charles Vacca, 39, was wounded until another employee ran over, according to the report. After realizing what had occurred, the girl's parents immediately removed her and their other two children from the property and brought them to the nearby restaurant so they wouldn't see what happened, the report states.
The New Jersey family had been vacationing in Las Vegas and on Aug. 25 was shuttled to Bullets and Burgers, the firing range at Arizona Last Stop property in White Hills, Ariz. The family had taken a ride on a monster truck before heading to the shooting range, according to the report.
The girl's father was the first to fire the weapon, identified as a Mini Uzi 9mm, and then it was the girl's turn. With the girl's mother recording, Vacca showed the 9-year-old how to stand and shoot the gun, allowing her to fire a few rounds.
At this point Vacca switched the gun into its automatic setting, according to a deputy who would later view the mother's video.

A number of people have said that it shouldn't be the law that stopped these people from handing a fully automatic weapon over to a nine-year-old, and I'm actually inclined to agree on that point. We shouldn't need to have a law because people should know better than to do such a thing.
I'd venture to say at least half the laws out there were written either because of idiots or because of people who lack whatever it is the rest of us have that keep us from being total dicks ...

i don't think she should be charged.....the instructor was culpable in his own death sadly from the looks of the video.
wolf I can understand her parents wanting to get her away from the immediate scene but I agree going to a restaurant was crass in the extreme. she wasn't being rewarded - she didn't do anything wrong - it was her parents, this establishment, this cultural mind set that giving a 9 year old a real Uzi to fire who were/are wrong.

But it is a good jumping off point for a discussion on the lack of clarity in this area of the law.
I mean...the girl took a human life. It's all in the framing. If the journalist wanted, he could have stressed how she hated the instructor, or how children think they can do anything they want. But he chose to frame the issue as one of allowing a child to shoot an automatic weapon. That verb alone--to allow--leads to a discussion about parent culpability, rather than the child's.
Maybe we should stop charging children as adults in the first place.

how could the journalist have said she hated her instructor? she never met the guy until that day.
I think someone could make a case for involuntary manslaughter against the parents or establishment. but not her. he was the one who clicked it to automatic.

Over here, granted such a situation is unlikely to ever arise, however if it did, two things are clear.
1 the child would NOT be charged as an adult...indeed as far as I'm aware that CANT be done, the "age of criminal responsibility" is quite clear cut. and she is below that.
2 it is unlikely, given what we know of the incident that any charges would in the end be applicable anyway, unless these were against the range by the H&S board...It is likely ..if the instructor was "self employed/freelance his death would be considered "misadventure"

for you Victor; she's a child and not responsible for what happened. It was an accident on her part and if any blame is to be laid it's certainly not with a little girl

Much prefer the prevailing Attitude here (or those that realise it is true for enough of us to make banning the best course of action)
We Admit we are violent motherfuckers who can in no way be trusted with weapons or to behave in a responsible fashion if given access to weapons.
