DNA Shows He’s Not a Killer. Georgia Still Wants to Execute Him Tomorrow.

Carlton Michael Gary was sentenced to death in 1986. He’s scheduled to die Thursday. In between came new evidence casting doubt on his conviction—and pointing to sabotage.

The courtroom drama was intense. On Aug. 15, 1986, Gertrude B. Miller, a 71-year-old white woman, testified about the night she was raped, beaten, and almost murdered by an intruder at her home in Columbus, Georgia, a prosperous city of 200,000 people south of Atlanta.

“I had gone sound asleep and it was then that I realized that someone was right there, on top of me… he turned me over on my back, and he pulled down my nightclothes… he raped me front and back, both, and he hit me on the head… Later on, when he was raping me, he turned the light on so he could see better, the light at the head of the bed.”

See he's already done 30 years. I think to execute him now is horrible. Over here he'd be out.

Prison with no parole is fair. To kill him thirty years later just isn't justice, its revenge.

This is why I have issues with the death sentence. Killing guilty people really doesn't bother me, but killing innocent ones does. And as I have gotten older, I have become acutely aware of how incompetent and untrustworthy the state is.

If there’s new evidence then why isn’t he having a new trial?

It's Georgia. He's black. It's southern racism.

I had no idea you lived in Georgia.

So did the judge say that? Did he say “No retrial because he’s black and this is Georgia”?

I simply want to know why he’s not having a retrial.

Well, that’s one reason not to have a retrial. He’s dead.
I suppose I’ll never know now.

Whether guilty or not, well never know, he's dead now, nothing can bring him back.

You don't have to live in the state to know what goes on there. I've been there and seen, many times. I have many friends from Georgia who tell me what it's like. I have lived in other parts of the south--Florida and Louisiana--where they behave the same.

Bad guys with bad motives don't admit their sins.

I have no idea whether the judge was racist or not so it’s all speculation, but what isn’t fair is not giving a man a retrial when there is new evidence.

They wanted to use the drugs before their sell by date. So have done lots across America.

Trust me, if he was appointed to a judge in a southern state, he's a racist.
