Are Republicans using healthcare to prevent a recess appointment?
It is clear that the Kremlin wants the Russia investigation to go away. Their man, Trump, can't do it because he must go through the chain of command: the only one who can fire the special prosecutor is his immediate superior, Deputy AG Rod Rosenstein. But the only one that a president can issue orders to is the Attorney General Jeff Sessions. By recusing himself from the Russia investigation, Sessions has locked Trump out of the process: Sessions can't touch the special prosecutor, and Trump can only fire Sessions.
There is an added twist. Trump might fire Sessions and appointment a replacement Attorney General...one who is amenable to firing the special prosecutor. BUT...he would have to pass the CONSENT of the Senate. At this point the Senate may stall the appointment by never taking a recess, as they did with President Obama's appointment of Merritt Garland to the Supreme Court. Then, every appointment must pass through the gates of the Senate, and thus be stalled.
However, if the Senate were to take their August recess, then Trump, as president, could make a "recess appointment'. A recess appointment is an appointment, by the President of the United States, of a senior federal official while the U.S. Senate is in recess. The Constitution says that appointments made by the President must pass the consent of the Senate, but while the Senate is in recess the President may act alone by making a recess appointment to fill "Vacancies that may happen during the Recess of the Senate."
So, here's the president's plot: wait until the Senate is in recess in August, make a recess appoint of someone who has pre-agreed to fire Sessions, then fire Sessions and then the special prosecutor.
Are you with me so far? In order to prevent this plot from happening, the Senate might forego it's August recess. But, how to do it without appearing to play checkmate to the President's check? You hold hearings on a bill that hasn't a ghost's chance of passing, that you know won't pass, that could never pass, that declared Senators have said can't pass...but you forego the August recess doing so. Trump can't make a recess appointment while the Senate is in session, and thus it would be meaningless to get rid of AG Jeff Sessions.
It just may be that Republicans are not Russo-Republicans after all. The abominated Senate Majority Leader, Mitch McConnell, might be the hero in all this. I still hate him, but the game is with the Russians this time. So, I'd forgive him this once.
