Labour peer Lord Janner will face a trial of facts over child sex abuse allegations, the Crown Prosecution Service has confirmed.

It overturns the severely criticised decision by the Director of Public Prosecutions, Alison Saunders, not to prosecute the 86-year-old because his dementia made him unfit to face trial.

The review increases pressure on Ms Saunders to resign over her decision in April not to pursue charges against Lord Janner for 22 sexual abuse claims dating back to the 1960s and spanning 30 years.

The DPP was criticised for failing to consider a trial of facts, where a defendant is found unfit to stand trial but the evidence in the case is heard and the court decides whether they carried out the acts they have been accused of.


I'm pleased they have reconsidered this case it needs to be looked in to...

I feel a bit sorry for his family tbh. Imagine having all that splashed all over the press.

A judge will now decide if Lord Janner is fit to stand trial. If not, he will face what is known as a "trial of the facts", where a court hears evidence from alleged victims and decides only if Lord Janner committed the physical acts of abuse. There will be no finding of guilt or conviction.

So how can he defend himself if he's not fit to stand trial? I know that not all defendants take the stand anyway, but they at least are able to give their side to the defence beforehand.

Not if he's not fit to stand trial. If he has dementia, he can't really defend himself. His family are entitled to try and protect him if they think he won't get a fair hearing.

they reckon he attended parliament 29 times last year, they should see if he voted and if he spoke and what he actually proposed if anything, that at last would show something about his capacity to understand and remember..

besides that it sounds like the amount of evidence from witnesses against him he wouldn't want to answer questions...

it seems some have protection...like everyone knew tatchell was living with a 16 year old boy when the legal age of consent for gay sex was 21...

Today’s U-turn follows an independent review of the case ‎by the QC David Perry carried out following an outcry from alleged victims and campaigners against child abuse.

Mr Perry, one of the country’s most renowned prosecutors, ‎was appointed by the DPP to reassess her decision under a “Victims’ Right to Review” scheme that she introduced last year.

‎He agreed with Ms Saunders that the peer’s ill-health means that he will be deemed unfit to stand trial and that no action can be taken against him.

But he found that it was still in the public interest to bring charges because of the potential deterrent effect on future offenders and because the alleged victims should be allowed tell their stories in court.

‎Announcing today’s charges, Ms Saunders rejected calls for her to quit and vowed to seek justice for the peer’s alleged victims.

Saunders added: “The Victims’ Right to Review scheme has brought a much needed voice for victims of crime and this review shows that any decision can be reversed, no matter who has made it.


“It is a scheme I helped to bring in and it is a process I fully support and am not above. ‎”

Ms Saunders said she had sought to give the victims a voice by requesting that their testimony could be heard by the inquiry into child abuse being carried out for the Home Secretary by the New Zealand judge Justice Lowell Goddard.

‎But she said she accepted Mr Perry’s finding that this would be insufficient and that a “trial of facts” in court should be conducted, even if Lord Janner was found to be too ill to face trial.

which is why the standards for evidence is much higher in a "trial of facts"

ONLY proveable facts can be considered and NO inference may be drawn from them.....
