If Trump counter-sues, then his motion to dismiss is useless. He will be subject to discovery just the same. That's the one thing he can't let happen.

Trump has no counter-suit because he has had no injury. He won the election despite, even, the fact that he lost the popular vote by 3-million votes. It's a vacuous, mirror-image argument, put forth for political reasons.
The DNC lawsuit is not aimed to win. It is filed to keep alive the issue(s) in the event that Special Prosecutor Mueller is fired. Not that the DNC won't win--indeed, the DNC won the same case in the Watergate era--but that winning a mere monetary award is inconsequential. The victory is in keeping the public informed. Discovery serves that purpose in case Trump manages to shut down the special prosecutor investigation.
