The parents of a black 12-year-old girl are suing her Texas school after it allegedly failed to investigate a group of white students who put a rope around their daughter’s neck and dragged her to the ground.
The incident, which the parents say was intentional bullying, left “severe and painful” rope cuts in her neck, causing her mother to believe her neck had been ripped open and stitched back together again when she first saw it.
The mostly white, Live Oak Classical school in Waco has called the incident “an unfortunate accident”.
Her parents are suing for $3 million worth of damages including medical bills, physical pain, disfigurement and suffering by daughter - identified by her initials “KP” - and alleges the school failed to properly investigate the incident.
During the school’s overnight camping trip at the end of April, a group of students were playing with a rope swing tied to a tree, according to the Waco Tribune.
Three boys came up behind the girl, according to the lawsuit, wrapped the rope around her neck and “violently jerked” her to the ground.
According to the lawsuit, nobody helped her off the ground and the teacher allegedly did not look into whether the incident was deliberate and did not alert her parents.
“KP looked up, and saw the three boys an arms length from where she was laying. None of the three boys, nor anyone else, helped her off the ground or helped remove the rope from her neck as they would have done if it had been an accident,” the lawsuit read.
The school said in a statement that the accusations by the parent’s lawyers surrounding the incident are “false”.
A member of the board of directors, Jeremy Counseller, emailed a statement to The Dallas News.
“The student received first aid treatment immediately after the accident by a parent chaperone who is also a physician, and she was able to enjoy the remainder of the field trip, which lasted through the next day. Live Oak takes the safety of its students seriously and is saddened that one of its family suffered an unfortunate accident and injury.”
The school has denied a history of bullying of KP, including people not wanting to talk to her and one of the boys in the group behind the rope swing incident pushing and kicking her when the teacher was not looking.
School principal Allison Buras wrote an email to her mother, Sandy Rougely: “It sounds like he may have pushed on the back of her leg to make her leg buckle, which is something the kids sometimes do. Rarely is that done out of meanness but more out of a desire for sport.”
KP’s parents had not removed their daughter from the school earlier as they had trusted the school to prevent future bullying and that the children were not capable of causing such severe harm, according to a statement from their family’s lawyer, Levi McCathern.

Floor doesn't have to mean inside...we have forest floors for eg, ground can be used for an inside flat surface.

Authorities in Blanco County, Texas, say there’s no evidence of a crime after a 12-year-old black girl, identified only as K.P., sustained severe rope burns on her neck during a school field trip.
A photo of the girl’s injuries went viral after she alleged that three boys wrapped a rope around her neck and dragged her during the overnight trip in April with Live Oak Classical School.
Now, Blanco County investigators say the incident was an accident.
“The victim’s story seems to have evolved some, but no evidence was revealed that indicates that this was more than an accident,” Blanco County Sheriff’s Capt. Ben Ablon wrote in his seven-page conclusion.
He added: “As to the allegation, by the attorney, that this injury was the result of a racially motivated attack, there was no evidence found of any racially motivated act toward this victim by anyone at or associated with LOCS. This was even supported by the victim’s statement.”
The girl’s parents, Sandy Rougely and Kevin Parker, are suing the school for $3 million in damages, alleging negligence.
The girl told police, and the lawsuit alleges, that she was with a group of children at the camp on April 28, when the following happened:Behind her in this group, within an arms length, were three boys, one of whom was the same boy Sandy had alerted Live Oak was bullying K.P. During one swing, K.P. watched as some of the other kids pulled the pull-rope back, ready to swing another child. She watched the kids let the rope go, thinking this was just like every other turn. However, she did not see what the boys behind her were doing, and the next thing K.P. knew, she felt the rope wrap around her neck and she was violently jerked to the ground with the pull-rope wrapped around her neck.
Investigators, however, say K.P. has changed her tune, and said she was never targeted because of her race at school. The sheriff’s office also replicated the incident using an officer, and found that just by pulling the rope swing back and letting it go, one could get hurt. Ablon wrote in his report:Blanco County District Attorney David Hall told the Waco Tribune that there were inconsistent statements from all the students involved throughout the investigation process.I did discover that if I pulled the swing back as far as I could, then did not let go until it pulled back away, the end of the rope would snap or whip away from me. I had Cpl. Acosta stand where the victim had indicated she was when injured. Even without the force that would be added by having a child in the swing, the rope whipped with enough force to cause a rope burn to Cpl. Acosta’s neck, as it hit him.
“The many inconsistent statements also leave much room for reasonable doubt,” Hall said. “If I see clear reasonable doubt, I cannot in good conscience file criminal charges and try to convince a judge or jury otherwise.”

BTW - I know we've kicked this around but it wasn't relocated to this topic so it's out there in the open forum, somewhere. I do remember Tommykins many rants about 'faked rope burn marks' ...so this has been kicked around by our investigative group

presumably the filing of charges would "mark" for life those so accused...the shadow of guilt deserved or otherwise....
maybe your system is different in this respect
if for instance a charge is made over here UNLESS it is actually sent to full trial and not guilty recorded those charges remain as a black mark for ever (for instance you could never get a job with "vulnerable persons" becasue the fact you were charged with this offense would count against you in the background check even though there was never any guilty verdict....

however as i said here there is a different attitude to raising charges without very very good reason and rightly so, give the social and official attitude to someone so charged...innocent until proven guilty is only, it seems a legal nicety these days....

Interesting, none of us were right how the burn actually did happen and is a good example to wait until the evidence has been tested as it was. Which shows we did not exhaust all avenues, but more so as the swing seems very dangeroeus from reading this just by them testing this.
Poor that the parents lied to try and sue and damages real cases of racism.

And as with the CLEAR CONCISE 2 photo's that show how much of that 12 year old's neck was covered in that 'ROPE BURN' - you are still WRONG! The burn marks on her neck stretched from a position of 1 oclock round to 11 oclock not just one side like you said.

Tommy, if this had happened in Connecticut or upstate New York we might indulge in such presumptions. But it's important to take into consideration all the facts, with each pass.
This took place it a region where there is (what we may legitimately call) a presumption of racism alive and active. That makes all the difference in the world.

The swing was also found to be dangerous to operate for someone using it. The parents still may have a case.
