A US woman is facing a discrimination suit after refusing to write homophobic words on a bible-shaped cake she made for a customer.
Marjorie Silva, the owner of Denver’s Azucar Bakery, is facing a complaint from a customer alleging she discriminated against his religious beliefs.
Ms Silva says that she was asked last year to make a bible-shaped cake for a male customer. After the order was complete he asked her to write “God hates gays” on the cake with two men holding hands and a cross on top of them.
“After I read it, I was like ‘No way’,” Ms Silva told USA Today. “‘We’re not doing this. This is just very discriminatory and hateful’.”
Ms Silva gave the man some icing and a piping bag and suggested he write the words himself.
“It’s just horrible. It doesn’t matter if, you know, if you’re Catholic, or Jewish, or Christian, if I’m gay or not gay or whatever,” Ms Silva, 40, said. “We should all be loving each other. I mean there’s no reason to discriminate.”
Interestingly that is exactly what she is being accused of — discrimination. It comes as a fellow Denver bakery fights a similar charge for not making a wedding cake for a same-sex couple.
While the proceedings against Ms Silva have been kept confidential, KUSA-TV reports that the complainant is a man named Bill Jack. Mr Jack reportedly told the station that he “was discriminated against by the bakery based on my creed.”
Bible cake ... Marjorie Silva says she was happy to make a bible cake but not write homophobic words on the cake.
“As a result, I filed a complaint with the Colorado Civil Rights Division. Out of respect for the process, I will wait for the director to release his findings before making further comments,” he said.
Ms Silva meanwhile says she can’t understand how she is the subject of a discrimination complaint for refusing to “spread hate”.
“I really think I should be the one putting the complaint against him, because he has a very discriminating message,” she said.

what happens when feedom of opinion meets freedom of expression......
irresistable force > immovable object
cant see how she could be prosecuted as she is in a "catch 22" situation
if she does she surely is guilty of hate "speech" (or at least party to it
if she doesnt she is guilty of discriminating against the guys beliefs
oh dear......
On the otherhand of course ...in a SENSIBLE society the guy ordering this would get arrested for inciting/ attempting to procure the instruent with which to incite, hatered....

Not exactly; in the U.S. you can march on the street with signs reading "God hates gays," or worse. You can even make your children do it. Check it out:
This has been done for years, and it's their right under the law.
But the problem here is that people are equivalating the refusal to bake a wedding cake for a gay couple with the refusal to design a cake with a homophobic message, as though the complaints are the same. Of course it's completely different to refuse to do business with someone on the basis of their orientation. Silva was happy to sell this guy a cake and the icing needed to write the message he wanted -- he just wanted her to do it, and probably so that when she refused he could start a big stink about it.

I do not think she has anything to worry about:
After the order was complete he asked her to write “God hates gays” on the cake with two men holding hands and a cross on top of them.
If the contract was completed that she agreed to, she does not have do anything further to the cake.
He was not refused the cake and even given the necessary means to do the task himself he requested after the contract was complete, making the cake. She can argue she was not discriminating against his religious rights based off countless sayings of Jesus himself on love for example. Well I would do so.
Now the other story, they actually refused to make the cake altogether, so it will be interested which arguments are used here, but to me, she has a very strong case, based on the contract on making the cake and he received a cake on the specifications he asked for.

The provisions of the Amendments to the US Constitution (Religious prohibitions are in the First Amendment) are prohibitions upon the government, not people.
It takes legislation--like the Civil Rights Act of 1964--to craft laws that impose themselves on private citizens...and then you have to have authorization in the form of a Constitutional mandate.
Most of the time authority for legislation comes from the Commerce Clause of the Constitution.
What is different about the religious freedom provision is, you can claim anything is a religious practice and anything in the world can be challenged as violating the First Amendment. Even the equal protection clause doesn't have such a wide ranging field.
Case in point: sex with minors. If you have a religion that says you must procreate as soon as possible, you can claim that any law that restricts you from screwing 11-year old girls is an infringement on your religion. As one court has recently held:

However, the resolution of that question is not to turn upon a judicial perception of the particular belief or practice in question; religious beliefs need not be acceptable, logical, consistent, or comprehensible to others in order to merit First Amendment protection.”
