Lateral Thinking Puzzles
A man stands before a judge having been convicted of murder. The Judge says "Although your guilt is beyond all doubt, I cannot in good conscience send you to prison".

Seems a tricky one this LD and I'm sure I'm wrong here but...
The murder committed by the convicted was actually morally justifiable?
Perhaps this is one for "The Puzzler" ?

Hmm, the solution is a single sentence, jack-in-the-box type one as opposed to a long-winded technical explanation.

Was it actually a person that the man murdered, or something else. You can say for instance 'he murdered that song'.

I would guess that somehow he managed to get double jeopardy and damning evidence has shown up after the conclusion of the trial.
On the off chance it's something bizzare: He's a conjoined twin and the other sibling had nothing to do with the murder..
