You are right in that it then goes from a DUI classification, to a homicide classification. The question is, what form of homicide...with 50 different states, you probably have as many different sentences?

Yes, it is definitely a more severe crime. But Ethan Couch was treated as a juvenile and that creates another complication. The laws are different for juveniles and sentencing is much more lenient. The premise is that juveniles are much more rehabilitatable.

But even for a juvenile... he was well over the age of criminal responsibility... and given the seriousness of the crime being that he caused the death of 4 people and that killing someone while driving drunk is considered as serious as intentionally killing someone with a vehicle, ie murder, I would expect to see a custodial sentence without any question...
