Dad Accused of Intentionally Leaving His Son In Hot Car To Die, Trial To Start In Sept.

After being unable to secure a Cobb County jury this spring, about 250 Glynn County residents are expected to receive jury summonses as court officials prepare for next month’s murder trial of Justin Ross Harris.
Harris is the father accused of murdering his 22-month-old son, Cooper, by intentionally leaving him in his car to die on June 18, 2014. He was originally set to be tried in Cobb, but his attorneys in May filed for a change of venue after three weeks of jury selection.
Superior Court Judge Mary Staley Clark granted the request for a change of venue for the trial, citing in her decision constant media coverage that had led to potential jurors’ “pervasive” knowledge of the case.
In June, officials announced the trial’s move to Brunswick in Glynn County, about 68 miles south of Savannah, with the start of jury selection scheduled for Sept. 12. The announcement of the new venue came just two days ahead of the two-year anniversary of Cooper’s death.
Court Administrator Tom Charron said he had spoken to Glynn County’s court clerk last week and was notified that about 250 summonses were in the process of being sent out, less than the nearly 350 sent by Cobb earlier this year.
About 250 Cobb residents responded to those summonses, Charron said.
Cobb residents’ potential knowledge of the case had been cited as a reason for the large number of summonses sent when the trial was to be held here. The public’s knowledge of the case may not be as large a factor in and around Brunswick — about a five-hour drive from Marietta — but other factors are playing into the jury selection process.
“One thing the clerk mentioned to me was that they have a number of people who are over 70 years of age because it is an area where you have a large retirement population,” Charron said. “They wanted to make sure there were enough summons going out that we would have a big enough pool to select a jury.”
Another factor, Charron added, is the list of addresses provided by the state to court officials: Occasionally, the list contains incorrect addresses.
“When you do get an area like that where you do have seasonal people living there — I’m sure there are a lot of part-time citizens down there who may really live somewhere else, so I’m sure that all factored in,” he said. “And we’re also just trying to be cautious in the event we run into a number of the prospective jurors who may have read or heard something about the case, that we have an adequate number.”
Jury selection is expected to last about two weeks, with Charron saying that Judge Staley Clark’s plan is to question several jurors at a time, rather than question them individually like she and prosecution and defense did in Cobb.
Traditionally, panels of 12 jurors are questioned, Charron added.
“By being able to ask questions of panels of jurors and only individually questioning if a juror seems to have a lot of knowledge about the case, we really think that’s going to move jury selection along a lot quicker,” he said.
Though the Harris case has gotten national and even international attention in previous months, it remains to be seen how many details of the case Glynn County residents will know about.
A classified ad that has appeared in The Brunswick News, a daily newspaper serving Glynn and neighboring counties, encouraged anyone interested in the Harris case to listen to a podcast that has been dissecting the case and following its progress. The ad could be seen on the newspaper’s website Thursday afternoon.
Kim Isaza, spokeswoman for the Cobb district attorney’s office, confirmed published reports that said DA’s office subpoenaed the newspaper’s advertising director last month, asking them to disclose the name of the person who submitted the ad to determine if they were a potential juror or someone involved in the case. It was later determined that neither were the case.
Following the scheduled two weeks of jury selection, those connected to the trial are expected to have the last week of September off, as it is fall break for those in the Cobb County and Marietta City school systems. The trial itself could begin on Oct. 3, though it may start sooner or later depending on the pace of the jury selection process. The trial is anticipated to take five to six weeks total.
But before next month’s start in Glynn County, attorneys and prosecutors will return to Staley Clark’s Cobb County courtroom on Aug. 19 to argue a new round of motions in the case. Among the issues that have yet to be addressed is an effort from prosecutors to have jurors view the locations Harris and his son traveled to the day Cooper died.
Attorneys for Harris declined to comment for this story.

Justin Ross Harris, who is accused of killing his toddler son by leaving him in a hot car, was charged Friday on eight separate counts of sexually exploiting a minor.
Harris, who will be tried separately for the newest crimes, allegedly had explicit photographs of two underage girls, and sent nude selfies of himself to both of them, as well as an additional minor.
The 34-year-old Georgia man is also accused of “engaging in sexually explicit chats” with the girls, according to The Atlanta Journal-Constitution.

“We are concerned that the timing of this indictment is a calculated maneuver to inflame public opinion against Ross on the eve of jury selection,” Harris’ attorney, Maddox Kilgore, said in a statement.
Of the eight new charges, six are for disseminating harmful material to a minor and two are for sexual exploitation of children.
“After more than a 20-month investigation into every imaginable detail of Ross Harris’ life, this new indictment alleges no acts of cruelty, no deprivation, no abuse, nor any neglect of Cooper,” Kilgore said.
“The content and timing of this indictment confirms the absence of such evidence, and it signals the state’s desperation to convict Ross of the worst mistake any of us as parents could make.”
Harris’ son Cooper was just 22-months old when he died after his father allegedly left him inside a hot car for seven hours in June 2014.

June 18, 2014: Justin Ross Harris leaves his 22-month son Cooper in the back seat of his SUV as he goes to his job at the Home Depot corporate office on Cumberland Boulevard. Police say that Cooper, who was locked inside the car at about 9:30, probably died before noon. About 4:15 p.m., by his account, Harris drives two miles before noticing his son in the back seat. He pulls off in a shopping center parking lot and removes Cooper’s body. Witnesses at the scene call paramedics and police. At 10 p.m., Harris is arrested and charged with murder.
June 28, 2014: Cooper’s funeral is held in Tuscaloosa, Ala. By phone from jail, Harris thanks supporters for standing behind him. His wife, Leanna Harris, also speaks at the service. “[Cooper’s] in the most peaceful, wonderful place there is,” Leanna tells mourners.
June 29, 2014: Search warrants released to the public reveal that both Ross and Leanna Harris had recently researched hot car deaths.
July 3, 2014: Cobb Superior Court Judge Frank Cox rules there is probable cause to charge Harris with his son’s murder and denies bail. Harris remains in jail. During the hearing, prosecutors disclose that Harris was sexting with at least six women on the day that Cooper died.
July 10, 2014: Home Depot confirms that it has terminated Justin Ross Harris. Also on this day, it’s reported that Leanna Harris has retained her own legal counsel; and a toxicology report on Cooper shows negative results for drugs or other chemicals.
Aug. 8, 2014: Leanna Harris states in a crime victim report that she believes that Ross is innocent and calls him “a wonderful father.”

Dec. 14, 2015: Defense lawyers for Harris accuse the Cobb police of illegally taking his cell phone without a warrant. The defense calls the police investigation a “fishing expedition” and moves to dismiss any evidence taken from the phone. The defense also claims that when investigators sought a warrant for Harris, they portrayed Harris as unemotional, when witnesses instead claimed he was “hysterical.”
Dec. 15, 2015: Cobb police testify that Harris’ initial statements contradicted the evidence, which gave them probable cause to seek a warrant.
Jan. 29, 2016: Judge Staley denies the defense motions, effectively preserving key evidence collected by police against Harris before he was a suspect, during his interrogation and after his arrest.
Feb. 11, 2016: Leanna Harris files for divorce from Justin.
Feb. 22, 2016: Defense lawyers say evidence of Justin’s extramarital dalliances is irrelevant and should be excluded.

(CNN) A judge has sentenced suburban Atlanta father Justin Ross Harris to life in prison without parole for the murder of his 22-month-old son, Cooper, who died in 2014 after Harris left him in a hot car for seven hours while he went to work. Harris also received another 32 years, to be served consecutively, for convictions on four other counts.
Harris, 36, who appeared in an orange jumpsuit with his wrists shackled at his waist, cast his head slightly downward as the sentence was handed down. He briefly closed his eyes but offered little other reaction.
In addition to the life term, Cobb County Superior Court Judge Mary Staley Clark gave Harris a 20-year sentence on a conviction for first-degree cruelty to children and another 10 years for sexual exploitation of children. Those charges stemmed from a finding that Harris tried to convince a minor to text him photos of her genitalia.
Harris also received a year each on two misdemeanor counts of dissemination of harmful material to minors, also related to his texts.
Harris' legal team offered no mitigating circumstances or evidence ahead of the sentencing. Assistant District Attorney Chuck Boring told the court that this was a matter of the defense team's "trial strategy."
"There's not much to argue or say," Boring said. "The jury verdict basically says it all."
The only sentence that matches the "evil nature" of Harris' crimes, Boring said, is life in prison. Staley concurred.
The sentencing doesn't mean the headline-grabbing case is over. Harris' lawyers, who claimed the boy's death was a tragic accident brought about by a lapse in memory, say they intend to file a motion for a new trial. http://www.cnn.com/2016/12/05/us/justin-ross-harris-sentence/index.html
