A judge allowed two Muslim solicitors accused of trying to cheat the legal system to hide behind a cloak of secrecy for ‘cultural reasons’, the Daily Mail can disclose.


He banned reporting of the case of Asha Khan, 30, and her brother Kashif, 34, to prevent them allegedly being shamed in the eyes of their community.


In the latest farce involving secret justice, the pair were told they could enjoy the court’s protection because members of their family would pass judgment if the case was reported.


It is a privilege rarely bestowed on defendants in the justice system, which has operated on the principle of transparency for centuries. However, following a challenge by the Daily Mail, the restriction was lifted – enabling the case to be reported.


Judge Peter Hughes reversed his original ban after deciding that the principle of open justice was more important than saving the embarrassment of a defendant.


After almost a year of court appearances and legal argument, Miss Khan has been convicted of attempting to pervert the course of justice, while her brother was acquitted of the charge.

They were on trial accused of helping their father, Mohammed, dodge a speeding fine by pretending he was not driving at the time of the offence.


In a saga with echoes of the Chris Huhne scandal, he allowed a man who worked for the family to take the blame instead.

At the beginning of the hearings, Miss Khan’s barrister, Glenn Gatland, argued she would not give evidence properly in the presence of the Press because she was afraid of family repercussions.

He said she did not want to criticise her father in public – though she was quite happy to have her mother sit in the public gallery.


‘Miss Khan is quite upset that if matters are reported she doesn’t feel she would be able to give her evidence as freely as she would have done otherwise,’ said Mr Gatland. ‘Culturally, it’s very difficult for them to say things in public. The evidence would be impacted on by the cultural background of Miss Khan.’

Secret Courts: 8 nightmare scenarios now possible in Britain

Imagine suing the government for damages for torture and kidnap, and losing your case, without ever knowing the reason why. A former lawyer who resigned from the Lib Dem party over "secret courts" describes the chilling scenarios made possible by the recently passed Justice and Security Act.
The Justice and Security Act introduces so-called “secret courts” (Closed Material Procedures) into ordinary civil cases in Britain for the first time. Despite vehement opposition, it gained Royal Assent on 25th April 2013. It has not yet come into force. The rules of court provided for under the Act have not yet been passed. So, as yet, the procedures for secret courts are not being used. It is only a matter of time, however, before secret courts are in use in civil cases across the United Kingdom.

Closed Material Procedures (or “CMPs”) mean that one party is not able to take part in either part or the whole of a trial. This party will almost always be a civilian who is bringing a claim against a government agency. It could be a civilian who is the defendant in a case. The government and its lawyers are present during the CMP. The civilian and their lawyer

1 cannot be present,
2 cannot see the evidence the government is relying upon (and which is said to be national security sensitive information),
3 cannot know the government’s case on this evidence,
4 cannot challenge this evidence or the government’s case and
5 cannot know the reasons for the judge’s decision on that evidence and therefore (at least a part of) their case.

The civilian will be told whether they have won or lost, but not the full reasons why.

And in the meantime pregnant women have Caesarians ordered without their consent and the baby removed from them as soon as it is born.

While I accept than in the case of mental illness there may be medically valid reasons for such actions to protect the mother and baby there is no case whatsoever to keep the baby from the mother once she is back on her medication and perfectly capable of caring for the baby.

* SINCE 9/11, many countries have tightened up on their "homeland security" defences to such a degree, that they can now lock up innocent suspects for days on end with no legal representation, simply on a suspicion, a whisper, or a similar surname. And with no legal rights of redress to their victims ~ people have to take civil action to have their names cleared..   Suspect 

* UNDUE and unearned rights, extra legal protections, rewards and exceptions being given to police forces, that aren't available to other emergency workers, nor private orders in the same situations and circumstances.

* Police constantly warning the public "not to take the law into their on hands", not to attempt to defend themselves or their nearest and dearest ( Evil or Very Mad ), not to disable intruders into or onto your homes and properties, not to interfere when you see a crime being committed, not to take "vigilante" actions (even when the law refuses to help you !) ~ but to call for them first ~ just bad luck if the police are 2 or 3 hours away, or even worse if you're in imminent danger !    pale

* WHILE at the same time, we have seen the removal of funding for community aid panels, civil rights and enviro' watchdogs, appeals courts, victims and legal aid payments; and even the governments ignoring the advice of their on departments and advisors in favour of a company's lobbyists and lawyers ~ while the corporations continue to get new "rights" and protections, bigger tax breaks and more handouts by the week..
