If it's a work account, they need to have access to it in case the person goes off sick and they need to access an urgent email. I should think a lot of companies turn a blind eye to people sending personal emails in work time, but this company did tell the employee in advance that they were not allowed to send personal emails.

Put the clause into a employees contract.

Ceratinly do although reading the report if that's all that happened then it seems a wee bit trivial to sack him just for that but of course they are in their rights to monitor any internet related traffic going in or going out from their servers.
Most people are genuinly honest and don't do it that much but some people do take liberties which is disrespectful not only to their employer but also to their colleagues who graft away to help make the bisuness a succes and meet its targets.

there must be more too it......
and it is not clear the article says differnet things at different points if it is his Private Yahoo acoount then they should not be able to see the contents but can track the 'volume' of data being sent.
Some places to have rule regarding this but to enforce through spying instead of just blocking it shows technical incompetance and very poor management... I would suggest the only senerio this would occur is because they want to get rid of someone and need to find a reason. literally less than a tenth of the resources (and actually prevents it permantly) to put a firewall rule in place to block the traffic to the personal mail and communicator sites.
