Canada's top court has overturned all restrictions on prostitution, declaring that existing laws violated sex workers' right to safety.

The Supreme Court of Canada struck down bans on brothels, street solicitation, and living on the earnings of prostitution in a unanimous 9-0 decision on Friday, and gave the Canadian government one year to re-write the country's prostitution laws.

The impugned laws deprive people engaged in a risky, but legal, activity of the means to protect themselves against those risks.

While prostitution itself is technically legal in Canada, most prostitution-related activities were previously considered criminal offences.

In the decision, Chief Justice Beverley McLachlin said many prostitutes "have no meaningful choice" but to "engage in the risky economic activity of prostitution," and that the law should not make such activities more dangerous.

"It makes no difference that the conduct of pimps and johns is the immediate source of the harms suffered by prostitutes," McLachlin wrote.

"The impugned laws deprive people engaged in a risky, but legal, activity of the means to protect themselves against those risks."

The legal challenge to Canada's prostitution laws was brought by a group of sex workers who argued that the now-overturned restrictions put them in danger.

Katrina Pacey, a lawyer for the petitioners, called it "an unbelievably important day for the sex workers but also for human rights."

"The court recognized that sex workers have the right to protect themselves and their safety," she said.

Last year, a lower court in the province of Ontario struck down the ban on brothels on the grounds that it exposed sex workers to more danger.

Friday's ruling comes 34 years after the Supreme Court last upheld Canada's anti-prostitution laws.

Prostitution is legal in much of Europe and Latin America, and brothels are legal in numerous countries, including the Netherlands, Germany and Switzerland.

If someone is being forced into prostitution, that is simply unacceptable and should be dealt with. But for those doing it because the want or need to, they need to do it in a safe environment.

We are so hung up about sex, in all its forms. There are very few people in the world without the need or want of it, why is it such a big issue?

OK....I will now throw in my couple of pennies here!

Everyone used to get along really well and something changed.

Just before i was thrown out there was a problem between Les and i...After that i couldn't log onto the forum..It didn't recognize my password..I posted about this but the problem was never rectified.

Nems has been bloody awful and quite cutting towards me recently and i can't understand why because i've rectified spats by talking to her again, there is some kind of agenda going on that we all need to get over...I feel bloody awful because i linked to this site in the first place, and it isn't fair that the admin here should be having to put up with these disputes.

FFS!....There has been some really good debates going on here, at times i've seen that this forum has been busier that Flap...Can't we just all move on, if someone posts an abusive or irritating post against us...Can't we all just ignore the said post?

....It isn't that hard because i've done it and i'm a bit of a bloody hothead!

I think I just answered any questions you might have, Irn.  Bee is a friend of mine, going back to March 2008, and so I copied him on all the PMs we are discussing here and now.  I told "Admin of Speak" I was doing that.  I designated Bee as my "true witness".

And apart from that one episode, there have been very few PMs going back and forth between Bee and me, Nems, FTL, other than they wanted to know how my fractured ribs were healing.  Despite Sassy's paranoia, no one is or was plotting against her.  Everything was said on the open board, just as now.

So be careful, Bee knows everything about the events re the shutdown of Speak, directly from the mouths of the participants on that early December night.  He also knows the surrounding circumstances...as does everyone.

I've asked nicely, guys. If this doesn't quiet down I'm locking it down. NewsFix isn't the place for this.

 

IF an honest and hardworking sex worker wanted to fairly and squarely tender her/his services without any harassment or bad laws getting in the way, it seems that from this week the most friendly countries could well be Canada, New Zealand or even Australia ?

AS long as they ran a legitimate business in a low key and discrete manner..

Look we have been down this road before Sassy, I would not even go there on Irish culpability to crimes done, when Britain has a very long history of persecuting let alone the Irish for centuries but countless other nations and ethnic groups.
