Toddler put up for adoption because parents are heavy smokers
A judge recommends that a two-year-old boy is taken into care after social workers say his parents heavy smoking is causing him to suffer breathing difficulties:
A two-year-old boy has been put up for adoption because his parents are smokers. A judge ruled that the youngster should be taken into care after hearing that he was surrounded by a “visible cloud of smoke” at his home and was suffering from breathing difficulties. Detail of the case emerged in a written ruling by the judge following a family court hearing in Hull. Health visitor Julie Allen told the court she had never come across such a smoky house in ten years doing the job. Judge Louise Pemberton said the little boy needed an inhaler to help his breathing, but was being badly affected by the level of smoke in the house.

You can't stop people from smoking just because they have children, but they should do so outside and keep it away from the kid. They were given a chance to change their behaviour apparently.

Nobody is saying they should stop smoking, but clearly they cared little for the boys health by smoking around him constantly.
Like you say, they can go outside to smoke.

Basically they were killing him slowly with the smoke and while he was dying it was torturing him (because I'd class not being able to breathe properly all the time as torture) and he will probably suffer health complications for the rest of his life and be lucky not to get lung cancer at an early age. For once, absolutely agree with the social worker.

The kid had an inhaler, which suggests that he had been taken to the doctor about his breathing at some point.
There were other issues too - drug paraphernalia and the state of the house.
I think that every effort should be made to get parents to change their ways before a kid is taken off them, but if they refuse and it's affecting the kid, what else can be done?

I agree, it seems in this case they had no intention of changing, so didn't give a fig for the child and making it suffer.

In her ruling she explained: “On entering the living room Ms Allen described being able to see a visible cloud of smoke surrounding the father and (the boy).
“(The boy) was asleep on the sofa and had been unwell for some time by this point. Ms Allen described the room as 'so smoke entrenched that I had difficulty breathing'. She immediately expressed concern to the parents as to the impact of such smoke on (the boy), who had already been prescribed an inhaler within the previous month to help his breathing.”
The judge said the parents had been unable to appreciate the level of concern over their son’s health, nor adapt their behaviour.
Health and social services staff had also raised other concerns about the boy's care.
The judge was told that the boy's father had mental health problems and that their home had been “dirty, smelly and unhygienic”. There was also evidence of drug paraphernalia and the father had also tested positive for cocaine.

Agreed, there was much more to this than just cigarette smoke. The parents had been given every opportunity to change. Sad but the right decision for this toddler, he didn't stand much of a chance otherwise

It's a bit misleading because it wasn't the fact the parents smoked which was the issue, it was the fact that they smoked around the child in the house.
And yes - there were other issues. I don't know about neglect though.
