Bake my damn cake part bazillion.
Kern County Superior Court Judge David Lampe has ruled that owner Cathy Miller can continue to refuse to make wedding cakes for same sex couples.
“The State cannot succeed on the facts presented as a matter of law. The right to freedom of speech under the First Amendment outweighs the State’s interest in ensuring a freely accessible marketplace,” Lampe wrote in his ruling on Monday. “The right of freedom of thought guaranteed by the First Amendment includes the right to speak, and the right to refrain from speaking. Sometimes the most profound protest is silence.”
The case, which has received national attention, began in August when Miller – a conservative Christian – refused to make a wedding cake for Mireya and Eileen Rodriguez-Del Rio.
“A wedding cake is not just a cake in a Free Speech analysis. It is an artistic expression by the person making it that is to be used traditionally as a centerpiece in the celebration of a marriage,” Lampe wrote. “There could not be a greater form of expressive conduct. Here, Rodriguez—Del Rios plan to engage in speech. They
plan a celebration to declare the validity of their marital union and their enduring love for one another. The State asks this court to compel Miller against her will and religion to allow her artistic expression in celebration of marriage to be co-opted to promote the message desired by same-sex marital partners, and with which Miller disagrees.”
But Lampe wrote that his ruling was tied closely to the fact that Miller was being asked to create a cake for an event.
And he cautioned that religion does not give businesses a right to refuse service to groups protected by the Unruh Act in other circumstances.
“A retail tire shop may not refuse to sell a tire because the owner does not want to sell tires to same sex couples. There is nothing sacred or expressive about a tire. No artist, having placed their work for public sale, may refuse to sell for an unlawful discriminatory purpose. No baker may place their wares in a public display case, open their shop, and then refuse to sell because of race, religion, gender, or gender identification,” Lampe wrote.

See this is why the USA is less free
A Businesses has been held higher than a Human being.
So Obvious the Human Freedom Level is lower when you make Corporate entities have more rights than REAL people.
If a Business can't operate due to dysfunctional employees(even if it's the owner) that's the businesses problem and it doesn't deserve to have access to the market.

The business can operate. Walk in, buy your cake. But don't expect the state to use force to make someone design it.
And this wasn't a corporate entity, but an individual that didn't want to use their artistic ability to design a product they were opposed to.
Did you even read any of it before you started typing?

Tastries Bakery, owner Cathy Miller
it's a Business.. Again this Fallacy that a sole trader is entitled to Human Rights (over and above another Human) while operating as a corporate entity is why the USA has lower freedom.
It's not art its a wedding cake She owns and operates a business that sells wedding cakes to the Public, Open and Shut case of a Corporate Entity having more rights than Humans being in the USA.

You can still buy a wedding cake there. The cake decorator will not create custom cake for anyone she doesn't want to.
Lets say you had some sort of talent (It's a stretch, but stick with me). Lets say you did custom portraits. Quill comes in with his goat, and requests that you paint a portrait of him fucking his goat, while he actually fucks his goat.
In this particular case, you could tell Quill that he may buy any of your paintings, and by law you would have to sell him a painting. But you would not have to sit and paint a picture of him fucking his goat, because you don't really approve of people fucking goats.

Re: Bake my damn cake part bazillion.
Then I should not have a business offering Custom Paintings
Like Cathy Should not have a business offering custom cakes.
And that is NOT the case she refused to make a wedding cake, no mention of a custom wedding cake
Again the cake decorator is a Business entity If they want to be a private citizen then STOP SELLING COMPELTELY OR OPERATING A BUSINESS.
By her own admission she is not suitable to run a business that has interactions with the public anyway.

Miller said it went against her Christian beliefs to make a cake for a same sex couple.

Miller said. “I am incapable of doing something that would hurt my Lord and Savior.”

She wants to be an artist and only create art she is comfortable with.
Why do you want to force people to do things they don't want to do? Some sort of fucked up power trip?

And the ruling was quite clear. She had to sell them a cake that was already made.

No one is forcing them to operate a business. So She can make art the way she wants, simply close the business stop taking money for it and do it for the love.
So you think the Sandwich artist at subway can refuse to make their art for Texans? you can only have a premade one
