for a definative answer stormee, I would advise you to talk to the DWP people

however IF she qualifies by virtue of her or her husbands work to a U.S pension she should keep any pension she has from the states AFAIK

As she has obviously not paid any National Insurance here, I doubt very much she would get a pension, which is based on.   You need 30 years contributions to get full pension.

Doesn't make any difference if she hasn't paid NI, she might get a bit of benefit, but it won't be pension.

Does matter... as no uk citizenship would be high chance of being barred entry for anything more than short stay and therefore meaning not entitled to any benefits of any kind here...


If still uk citizen then options are available.

If it's outside the EU, she can't claim. If she hasn't paid into the system, i.e. a full stamp, then she'll have no entitlement.

Probably get something. But in old age a pension is vital here. She'd have to go on benefits and that is very very low paid thing. To be honest, if she's lived outside the UK for 55 years and never paid taxes or NI, why the hell should she get anything other than the basics.

She should be eligible for Social Security benefits (SSI), Medicare and housing subsidies, save she want's to return to the UK. She can collect SSI anywhere, but she'd have to show up for healthcare or housing.

Donno about UK benefits.

She will always be a citizen as long as she's within two degrees of sanguinity of a British citizen.  Since she is British herself, seems a done deal.

Not true I'm afraid Quill, there have been many case lately of very elderly mothers who had come back to live with family because they were very frail.   At the end of their visitors visa time the Government ordered their deportation.  In all cases the family were British and the parent had been British at birth, but went to live abroad.
