Maybe to some, but I've always understood a hate crime to be a crime committed against someone for belonging to a minority group that person was identified by the assailant as being part of, intended not only to hurt the individual but to frighten everyone like him or her. So while some might say that all violent attacks are driven by hate (which I think is nonsense; I believe far more are driven by desperation), I believe that an easy way to put it is that hate crimes target minorities for the purposes of intimidation.

I doubt it, but it would be dependent on how the statute was written up. However, if a gay person assaulting another gay person could be considered a hate crime, that would mean that the same thing could apply to two straight people (presumably of the same ethnicity, of course) and that could open a whole other can of worms.

what if one of them was bisexual and the bisexual beat up the homosexual, would the police have to say hat was a hate crime.

I would imagine they'd have to use other evidence to determine whether or not a hate crime had been committed -- why don't you e-mail your local police and ask them?

A few others should follow that lead as well, as they seem to be confused by hate crime laws, even though it's all been explained to them!

like skin colour, religion, sexuality or disability

Certainly could be -- I think you'd have to have more details, but rape has definitely been committed to intimidate a community.

A hate crime is not a hate crime because the victim is a minority, a hate crime is a hate crime because the perpetrator Choose the victim because the victim was a minority.

Like the difference between murder and manslaughter the difference is the intent of the perpetrator.
