A lot of people will indeed look at this in that sort of "lucky dude" way, but I think it discounts what the kid is probably actually going through ...

From the source:

Respess’ lawyer, Jeffrey Smith, said that if the tryst had taken place four days later, when the teen turned 17, there would have been no case, the station reported.

The legal age of consent in Louisiana is 17, the lawyer said.

That's a rather scummy thing to say, they still would have been his teachers and it still would have been exploitation.

In Australia and Britain there are laws concerning people in control or influence over "juniors", whether in age or ranking, taking advantage of those in their responsibility for sexual or monetary or personal gain..

NO doubt the American states each have their versions of these anti-exploitation laws ~ no matter how much some of the more backward and redneck states might have watered them down ?

It certainly seems that some conservatives think we're far too tough on adults who screw kids ...

This often happens: we confuse the teacher role with the age issue, and the latter is lost in the heap.  Or, maybe we want to avoid it altogether.

The philosophy of the law is that an under-aged person cannot form an intent.  Thus he or she cannot consent.  It 's a status law, and what was/is intended is of no consequence.

Can a male, as opposed to a female, be adversely affected by sex with an adult?  Of course, we know that an under-aged female can become pregnant, and that 's a bad thing (except when it's a good thing).  But that's another matter.  What about males?

Well, we know that Richard Allen Davis, the brutal rapist/murderer of 12-year-old Polly Klass, may have suffered from sexual abuse with an adult when he was under-aged.  At his sentencing hearing it came out through his sister's testimony that he was repeatedly raped by an aunt and her friend.  We'll never know what effect that may have had, because nobody cared to study the question.  But a case--albiet a weak one--might be made that there is a confusion that came about in his mind about sex and sexual priorities.  http://en.wikipedia.org/wiki/Richard_Allen_Davis

Again, we'll never know.  A part of the reason is that sex with a minor is a status crime, and as such no one wants to investigate the consequences...it's already illegal, so why bother?
